SUBSCRIPTION TERMS & CONDITIONS
(Tutoring Services)
These Subscription Terms & Conditions apply to all monthly tutoring subscription packages offered by:
SmartPrepRemote (Pty) Ltd
Trading as SmartPrep and Cape Town Tutors
(collectively referred to as “the Company”, “we”, “us”, or “our”).
1. Subscription Structure
1.1 Tutoring subscriptions are monthly recurring packages that include a fixed number of tutoring sessions per month.
1.2 Subscriptions are intended for ongoing academic support and are typically scheduled on a weekly basis unless otherwise agreed in writing.
1.3 Sessions may be conducted online or in person, depending on the subscription package selected.
2. Minimum Subscription Period
2.1 All tutoring subscriptions require a minimum commitment period of two (2) consecutive months.
2.2 Subscriptions may not be cancelled during the minimum subscription period.
2.3 After completion of the minimum period, subscriptions will continue on a month-to-month basis unless cancelled in accordance with Clause 9.
3. Billing & Payments
3.1 Subscription fees are billed monthly in advance.
3.2 Payment must be received prior to the commencement of sessions for each billing period.
3.3 Failure to make payment may result in the automatic suspension of tutoring services.
3.4 All fees are quoted and payable in South African Rand (ZAR).
4. Pricing & Subscription Discounts
4.1 Subscription packages are offered at discounted rates compared to standard hourly tutoring rates.
4.2 Subscription discounts apply only while the subscription remains active and compliant with these Terms.
4.3 In the event of early cancellation or suspension due to non-payment, the Company reserves the right to recalculate sessions already delivered at standard hourly rates.
5. Scheduling & Session Use
5.1 Sessions are scheduled in advance and allocated to reserved time slots.
5.2 Sessions must be used within the relevant billing month.
5.3 Unused sessions do not roll over to subsequent months and are forfeited if not used.
5.4 The Company does not guarantee a specific tutor but ensures all tutors meet the required academic and quality standards.
6. Cancellations & Missed Sessions
6.1 A minimum of 24 hours’ notice is required to cancel or reschedule a session.
6.2 Sessions cancelled with less than 24 hours’ notice, or missed without notice, will be charged in full and forfeited.
6.3 No refunds or replacement sessions will be issued for missed sessions.
7. Tutor Availability & Changes
7.1 Subscription clients receive priority tutor allocation.
7.2 Should a tutor become unavailable, the Company will make reasonable efforts to assign a suitable replacement.
7.3 A change of tutor does not entitle the client to a refund or cancellation.
8. Pausing a Subscription
8.1 A subscription may be paused once per subscription period, for a maximum of fourteen (14) days, subject to availability.
8.2 Pause requests must be submitted in writing at least seven (7) days in advance.
8.3 Paused periods do not extend the minimum subscription period unless agreed in writing.
9. Cancellation After Minimum Period
9.1 After completion of the minimum subscription period, clients may cancel their subscription by providing thirty (30) days’ written notice.
9.2 Cancellation will take effect at the end of the next billing cycle.
10. Refunds & Credits
10.1 Subscription fees are non-refundable once a billing cycle has commenced.
10.2 In exceptional circumstances, the Company may issue service credits at its sole discretion.
10.3 Any credits issued:
- Are non-transferable
- Have an expiry date
- Cannot be redeemed for cash
11. Public Holidays & Tutor Leave
11.1 Sessions scheduled on public holidays are not automatically rescheduled unless agreed in advance.
11.2 Tutors may take reasonable leave; affected sessions will be rescheduled where reasonably possible.
12. Amendments & General
12.1 The Company reserves the right to amend these Subscription Terms & Conditions with reasonable notice.
12.2 Continued use of subscription services constitutes acceptance of the updated Terms.
